Terms of use and purchase — My Climate Risk and Climate Note

Last updated: 23/10/2026

These terms govern the use of the My Climate Risk, the street-level building sheet and the purchase of the Climate Note offered by Canal Meteo. By creating an account, you accept them. If you buy a Note or subscribe to a plan, sections 5 to 9 also apply. Please read them carefully: we have written them so that you can understand them without being a lawyer.

1. Who provides the service

Poniente Media Group LLC, trading as Canal Meteo, a United States limited liability company (LLC) incorporated in Texas (file number 805980905), with tax number (EIN) 33-4452828 and registered address at 5900 Balcones Dr Ste 100, Austin, TX 78731, United States. Contact: hola@canalmeteo.tv · Website: miriesgoclimatico.com

Hereinafter, "we" or "Canal Meteo". "You" or "user" means the person who uses the service.

2. What the service is

We produce it from open public data (Catastro and the foral cadastres, MITECO/SNCZI, IGN, USGS, NASA, ESA, Copernicus, WRI, CHELSA, JRC and OpenStreetMap, among others) and from a method that we publish, together with its sources and limitations, in Legal notice and methodology.

3. What the service is not

The building sheet and the Climate Note are indicative information for public awareness. In particular:

Paying for the Climate Note does not change its nature: it is still an estimate based on public data. To decide on a purchase, a rental, insurance, a mortgage or building works, consult the official information (river basin authority, Land Registry, Catastro, town council) and a qualified professional.

4. Your account

5. Purchases: single Climate Note and plans

5.1 Products and prices.

Product What it includes Price (VAT included)
Single Note One credit to generate one Climate Note for any building in Spain. The credit does not expire €9.90
3-Note bundle Three Single Note credits, to compare several homes. They do not expire €19.90
Pro plan (professionals) Monthly subscription with 30 Notes per month and your brand on the PDF, to hand them to your clients €49 per month + VAT
Annual Pro plan The same as the monthly Pro (30 Notes each calendar month, not carried over), paid for one year €590 per year + VAT
API Notes per request, for professionals, under a separate contract (section 9) As per contract

5.2 How to buy. You need to be signed in to your account to buy. The steps are: 1. You choose the product on the website and see its final price. 2. You go to the secure payment page of our payment provider, Stripe, where you see the summary again and can correct your details before paying. 3. By pressing the payment button you accept these terms and the obligation to pay. 4. We email you a purchase confirmation with its receipt, on a durable medium, and, if you generate the Note immediately, confirmation that you asked for it (section 6).

The contract can be concluded in Spanish and English (the legal texts exist in these two languages; the Spanish version prevails). We keep the record of each purchase and the version of these terms you accepted; you can ask us for a copy at hola@canalmeteo.tv.

5.3 Payment. Payment is made by card or other methods offered by Stripe on its payment page. We do not see or store your card details: Stripe processes them.

5.4 Delivery. The Climate Note is digital content generated on the spot: when you press "Generate the Note", the PDF is created and you can download it straight away. It remains available for download in your account for 30 days.

5.5 If something goes wrong. If the Note is not delivered, the PDF is damaged or it does not match what you asked for, write to hola@canalmeteo.tv: we will generate it again or refund what you paid for it. This does not limit the rights that consumer law gives you regarding the conformity of digital content. Disagreeing with the score is not a defect of the product, but you can ask us to review a figure (section 12).

6. Right of withdrawal

If you are a consumer, as a general rule you have 14 calendar days to withdraw from a distance purchase without giving any reason.

Climate Note (single or within a plan). The Note is generated and delivered on the spot. That is why, before generating each paid Note, we ask you to tick this box, which is not pre-ticked and without which you cannot continue:

☐ I ask for the Climate Note to be generated and delivered to me now, before the 14-day withdrawal period ends, and I understand that, once it is generated, I lose my right of withdrawal for it.

If you tick it and the Note is generated, you lose the right of withdrawal for that Note (art. 103.m of the Spanish consolidated consumer protection law, TRLGDCU). We confirm this by email.

Single Note bought and not yet used. You can withdraw within 14 days of the purchase and we refund the full amount.

Subscriptions. You can withdraw within 14 days of subscribing. If you have not generated any Note in that period, we refund the full amount. If you have generated any, we refund the amount paid minus €9.90 (the Single Note price) for each Note generated, never more than the amount paid.

How to withdraw. Write to hola@canalmeteo.tv from your account email saying that you withdraw, or use this model:

To Canal Meteo (hola@canalmeteo.tv): I hereby give notice that I withdraw from my contract for [Single Note / Premium plan / Pro plan], concluded on [date]. Account name and email: [...]. Date: [...].

You can also withdraw with one click from Account › «My payments and withdrawal» › «Withdraw from the contract»: you see at once which payments are within the period and how much we refund, and we confirm the withdrawal by email. Purchases made in the App Store are refunded by Apple (reportaproblem.apple.com).

We will refund you within 14 days of receiving your decision, using the same payment method you used, at no cost to you.

If you contract as a business or professional, you have no right of withdrawal.

7. Subscriptions: renewal and cancellation

8. Deleting your account: what happens to your purchases

When you delete your account:

9. API for professionals

The API is offered to businesses and professionals under a specific contract. In addition to that contract, these terms apply. API keys are secret and belong to the account that receives them: you are responsible for their use. We may revoke a key if it is used against the contract or if there is a security risk.

10. Permitted and prohibited use

You may use the service, the building sheets and the Notes for personal and information purposes: to learn about your home or your neighbourhood, to prepare questions for a seller, a notary, an insurer or a technical expert, or to share a specific Note with your family or your adviser. With the Pro plan or the API you may also provide Notes to your own clients.

It is not permitted to: 1. Download in bulk or automatically (scraping, bots, crawlers, API calls without a key or outside a contract) building sheets, Notes, tiles or data from the service, or try to circumvent usage limits, plan quotas or technical measures. 2. Redistribute or resell building sheets or Notes beyond what is permitted in the previous paragraph, or use them to build databases, rankings or lists of properties, streets or developments, or publish them in bulk. 3. Present the Notes as endorsed by Canal Meteo in advertisements or commercial material without our written authorisation. Putting your brand on a Pro-plan Note does not authorise you to say that Canal Meteo vouches for a property. 4. Use the service to discriminate against people, for example to refuse housing, a rental, insurance, a loan or employment because of the neighbourhood or building where they live, or for any unlawful purpose. 5. Present a building sheet or a Note as something it is not (appraisal, certificate, official report), alter it, or remove the sources, dates and notices it contains. 6. Try to identify the owners or occupants of properties by combining the service with other sources. 7. Interfere with the operation of the service, introduce malicious code or access non-public areas or data.

If you break these rules, we may suspend or close your account (section 16).

11. Intellectual property and data licences

12. Accuracy and correction of errors

We work diligently, publish the method and date the sources, but public data have limits of resolution, date and coverage, and our assignments to each building may be off by several metres. There may be errors.

If you see one, write to hola@canalmeteo.tv giving the address or the cadastral reference and the reason (if you can, attach a source). We will review your message within 7 calendar days of receiving it and reply to you. If we confirm the error, we will correct the figure or add a note; if it affects a Note you paid for, we will generate it again free of charge. If the cause lies in the official source, we will explain it to you and, where appropriate, report it to the body that produces it. As a media outlet, we also handle the right of reply (Ley Orgánica 2/1984).

13. Service availability

We try to keep the service available and up to date, but it may be interrupted for maintenance, technical failures, or because public sources change or become unavailable. We may modify, extend or reduce features; if a change significantly reduces what your plan includes, we will let you know and you may cancel with a refund of the unused part. If we decide to close the service, we will give you at least 30 days notice so that you can download your Notes, and we will refund the proportional part of paid subscriptions and unused credits.

14. Liability

  1. Our liability. We are responsible for providing the service with the reasonable diligence of a specialised media outlet working with public data: using the sources we state, applying the published method, dating the data, handling corrections and delivering the Note you paid for.
  2. What we do not guarantee. Given the nature of the service (section 3), we do not guarantee that third-party data are complete, accurate or up to date, or that a property will behave as the building sheet or the Note indicates. Any decisions you make with them should be based on official information and professional advice.
  3. What we never exclude. Nothing in these terms excludes or limits our liability for wilful misconduct or gross negligence, for death or personal injury caused by our acts or omissions, or any right that consumer protection law grants you and that cannot be excluded by contract. If you are a consumer in Spain, this includes the rights granted to you by the TRLGDCU, including those on the conformity of digital content.
  4. Business users. If you use the service for business or professional purposes (and are therefore not a consumer), to the extent permitted by law, we are not liable for loss of profit, loss of business or indirect damage, and our total liability is limited to what you paid us in the 12 months before the event giving rise to it.
  5. Your liability. You are responsible for any use you make of the service, the building sheets and the Notes in breach of these terms, for example if you redistribute them or use them to discriminate against someone.

15. Changes to these terms

We may update these terms, for example because of legal changes or changes to the service. We will publish the new version with its date. If the change is significant, we will email you at least 15 days before it takes effect. If you do not agree, you can cancel your subscription or delete your account before that date, at no cost. Changes do not affect purchases already made (they are governed by the version you accepted) and do not apply retroactively. Subscription price changes follow section 7.

16. Cancellation, suspension and closure of the account

17. Governing law and courts

  1. General rule. These terms are governed by the laws of the State of Texas (United States) and by applicable United States federal law.
  2. If you are a consumer and live in Spain or in another European Union country: - The choice of Texas law does not deprive you of the protection afforded to you by the mandatory rules of the law of your country of residence (art. 6.2 of Regulation (EC) 593/2008, "Rome I"). In Spain, this includes the TRLGDCU, data protection law and the LSSI. If those rules protect you more, they apply. - You can bring a claim before the courts of the place where you are domiciled, and we can only sue you before those courts (arts. 17 to 19 of Regulation (EU) 1215/2012, "Brussels I bis"). - Nothing in this section limits your right to go to the consumer or data protection authorities (the AEPD in Spain).
  3. Business users: courts of Travis County, Texas, to the extent permitted by law.
  4. Amicable resolution. Before making a claim, we ask you to write to hola@canalmeteo.tv: we will try to resolve it within 15 working days. This step is voluntary and does not prevent you from going directly to the courts. We are not currently a member of any consumer alternative dispute resolution body. The former European online dispute resolution (ODR) platform ceased to operate on 20 July 2025.
